The Demise of the 28-Clause Peace Initiative for Ukraine: Why Diplomatic Efforts Continue to Stumble

Europe breathed a deep collective sigh of relief on Monday, as the diplomatic emergency sparked by the presentation of a new 28-article proposal for resolving the conflict appeared – momentarily – to have been defused. A Washington representative spoke of "substantial progress" after bilateral negotiations in Geneva. On Monday night, Moscow made its countermove: another massive barrage of missile and drone strikes on Kyiv.

The Pattern of Negotiation and Warfare

The succession of conflicting incidents captured the bleak nature of the outgoing year. By day, diplomatic battles are conducted: hopeful statements are delivered from different nations. Significant resources is expended on restraining particular approaches. By night, Russian leadership clearly shows the world that, for them, conflict continues to be the primary tool for achieving "settlement".

Nighttime Reality

As Russia's attack progressed into the early hours of Tuesday, the current condition of Ukraine's defenselessness was revealed. Ukraine is equipped to monitor missile launches from across the border, a ability enabled by up-to-date information. From witness perspectives, Ukrainian air force fighter jets that had been deployed to counter approaching guided weapons streaked across the sky – modern combat jets provided to Ukraine by Western partners.

Shortly after, Kyiv's air-defence systems activated: multiple launches deployed against a hostile projectile. This was a sophisticated defense system at work, presumably provided by partner states. Every firing creates sudden vibrations, shaking the windows. The brief panic quickly becomes resigned acknowledgment: maybe the approaching threat won't hit its mark this time, sparing the city from catastrophe and another blackout.

Ongoing Risks

Not long after, a heavy machine gun engaged a unmanned aircraft in the vicinity, part of a mobile-fire group – most likely allied-provided weaponry. Sadly, the projectiles didn't strike the hostile drone – it maintained course toward its destination.

With pauses, this carried on until dawn. Kyiv awoke to the daybreak reports: several casualties, damage and heating outages in many homes as a result of the nocturnal offensive. As typically, everyone still continued their routines – living the war. But those 24 hours illustrated Ukraine's vital need on external assistance – a dependence that neighboring countries are demonstrably unable to replace in the short term.

Unsuccessful Negotiations

The comprehensive proposal from US administration provoked deep reactions, discussion and serious worry – and momentarily shifted focus from Ukraine's most significant graft case in years. Yet, we have witnessed similar scenarios, after prior negotiation attempts and multilateral gatherings.

Every new proposal from American administration follows the identical sequence: a negotiation push against Ukraine, which Kyiv, with other European capitals, succeeds in resisting. They contain the crisis but never actually win the battle. This cycle will, undoubtedly, persist.

Tactical Assessments

It is easy to blame specific actors of repeatedly advocating Kremlin's demands. But that does not seem to be the entire situation. American leadership functions according to a assumption understood by seasoned negotiators: you cannot win at the negotiating table what you have lost on the battlefield. The US administration believes that it is impossible to compel Moscow to relinquish the territory that it presently holds in Ukraine's occupied territories.

The problem is that while accepting these circumstances, American administration does minimal to prevent Kremlin actions, through statements or actions, from believing that the situation will not evolve additionally in its advantage in the near future.

Divergent Views

Therefore, the Kremlin is convinced that duration works to their advantage – that Ukraine and its partners are approaching exhaustion. Their reason to agree to terms that does not give them the greatest potential benefit is close to zero. There may be numerous efforts to stop fighting, but they will persist as long as Russia's government remains completely certain in the conclusion.

On the contrary, Ukraine's government believes that Ukraine can still persist, gradually sacrificing people and territory but avoiding a complete military breakdown until situations evolve in its benefit.

Existing Situation

Objectively, there are no real preconditions for a armistice. Now, personal considerations are coming into play: personal goals to broker a ceasefire and achieve global acclaim, and the government's dual difficulties – on one hand, not to alienate a key ally, and on the other, to unite the population around the national cause against any proposal Kyiv finds unacceptable, so that their focus does not move to internal issues. And although their mission will now be much harder after recent developments, it remains quite doubtful that this will alter their fundamental strategy.

These opposing factors are guiding negotiations.

Summary and Prospects

It took a only one week to kill the proposed articles of the current initiative. Forceful and unpredictable management of the matter by Washington, resistance by Ukraine and the rest of Europe, along with pacifying measures of representatives, and finally, latest revelations, all served their function.

While new proposals based on previous concepts are forthcoming, Kyiv, London and other allied nations should arrive at a critical understanding: Ukraine and Europe will only be able to resist diplomatic offensives from Washington that are based on Russian demands and reflect particular unwillingness to alter the situation, if they remain united and enhance their military capacity at a considerably quicker tempo. If they do, no combination of diplomatic or military actions will be able to break them. In the meantime, Ukraine's ability to repel nightly air assaults will, for the coming months, mainly require continued Western support.
